Widerrufsbelehrung
Der Verbraucher kann den Vertrag innerhalb von 14 Tagen ab Erhalt der Ware schriftlich, ohne Angabe von Gründen widerrufen. Zur Fristwahrung genügt die rechtzeitige Rücksendung der Ware.
Im Falle des Widerrufs sind die empfangenen Leistungen unverzüglich zurückzugewähren. Der Verbraucher hat Wertersatz zu leisten, wenn der Wertverlust auf einen Umgang mit den Waren zurückzuführen ist, der zur Prüfung der Beschaffenheit, der Eigenschaften und der Funktionsweise der Waren nicht notwendig war.
(1) Rücksendekosten für Verbraucher
Als Verbraucher haben Sie im Falle des Widerrufs die Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der Bestellten entspricht.
(2) Die Ware ist möglichst in der Originalverpackung zurückzusenden um Transportschäden zu vermeiden.
(3) Desweiteren gilt bezüglich Rücksendungen die Ausführungen in unserer Widerrufsbelehrung.
Das Widerrufsrecht gilt nicht für Verträge zur Lieferung und/oder Herstellung von Waren, die nicht vorgefertigt sind und für deren Herstellung eine individuelle Auswahl oder Bestimmung durch den Verbraucher maßgeblich ist oder die eindeutig auf die persönlichen Bedürfnisse des Verbrauchers zugeschnitten sind. § 1 Cancellation instructions, cancellation right
You can cancel your contract declaration within two weeks in text form (e.g. letter, fax, e-mail) without stating a reason - or if the item is delivered to you before the passing of the deadline - by return shipment of the item. The 14-day period begins upon receipt of these instructions in text form, however not before the receipt of the merchandise by the customer (in the case of repeat delivery of similar merchandise not before the receipt of the first partial delivery) and also not before the fulfilment of our information obligations in accordance with Art. 246 § 2 in connection with § 1Para. 1 and 2 EGBGB as well as our duties in accordance with § 312e Par. 1 clause 1 BGB in connection with Art. 246 § 3 EGBGB. § 2 Consequences of cancellation
In the case of an effective cancellation the services received from both sides must be returned and if applicable derived benefits (e.g. interest) must be reimbursed. If you cannot return the received service either completely or partially or only in a worsened condition, then you must insofar pay us value replacement. This does not apply for the surrender of goods, if the deterioration of the product can be attributed solely to the inspection thereof, in a manner similar to inspecting a product personally in the shop. Incidentally, you can avoid the obligation for value replacement for a deterioration resulting from proper usage of the item by not treating the item as your own property and refraining from everything which affects its value. The return shipment is made at our risk. You must bear the costs of the return shipment if the delivered merchandise conforms to the ordered merchandise and if the price of the item to be returned does not exceed a value of 40 Euros or if in the case of a higher price of the item you have not yet made payment at the time of the cancellation or not made a contractually agreed upon partial payment. Otherwise the return shipment is at no cost to you - for this also see § 6 AGB - TC (view in new browser window). Obligations for the reimbursement of payments must be fulfilled within 30 days. The time period begins with the shipment of the cancellation declaration or the item, for us with its receipt.
§ 3 Special notes
The right to cancellation does not exist for remote sales agreements for delivery of merchandise which is manufactured according to customer specification or is clearly customised to personal requirements or by reason of its design is not suited for a return shipment or can quickly spoil or has exceeded the expiration date.
